Hereinafter referred to as “The Seller”,

– Natural or legal persons with contractual capacity wishing to purchase one or more photographic services for sale on the website accessible from the URL address https://packshot.ma.
Hereinafter referred to as “The Customer”,
– The present general conditions of sale are brought to the attention of the client in accordance with Article L 113-3 of the French Consumer Code and are posted on the Packshot Studio website.
Packshot Studio may revise its general sales conditions at any time and publish them on its website https://packshot.ma.
The general sales conditions applicable are those in effect on the https://packshot.ma website at the time the order is placed by the client.
ARTICLE 2 – ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
Any request for service made by the customer implies his unreserved acceptance of these general conditions of sale.
The customer is informed and accepts that the seller can delegate the delivery operation to a third party of his choice.
ARTICLE 3 – SERVICES
The services offered by Packshot Studio are those listed on the https://packshot.ma website on the day of the client’s consultation.
Each service has a precise description, including price, duration and key conditions.
Packshot Studio is committed to providing services that comply with legal and regulatory requirements in terms of health and safety.
ARTICLE 4 – PRICES
The prices indicated on the order of service are expressed in EURO, and get along all inclusive of tax and except expenses of port.
The applicable VAT is the one in force in metropolitan France on the day of the order.
Packshot Studio reserves the right to modify its prices at its own discretion. Prices for packshot services are based on the quantity of images and additional services.
ARTICLE 5 – QUOTATION
The customer sends a request for a quote for the desired service on the website https://packshot.ma
The customer establishes a list of products to be photographed and specifies the desired quantity and the type of photos that the customer wishes to obtain.
The customer sends an e-mail describing precisely the characteristics of the product to be photographed to the following e-mail address: contact@packshot.ma
To obtain an accurate price, customers include product photos in their e-mails.
ARTICLE 6 – RECEPTION
Within 48 hours of confirmation of the quote, the seller will email the customer a quote with the price, time frame and shipping instructions for the product to be photographed.
If there are special instructions for taking photos (e.g., preferred angle), the customer will provide this information in the package or via e-mail.
The customer includes a detailed list of the product and its quantity in the package. Once the shoot is completed, the document will be signed with the product and returned to the customer.
The client sends the product to the address indicated and it is carefully packed:

The shipping costs are borne by the client.
ARTICLE 7 – PRODUCTION
After receiving the item, the seller will continue to check the product and quantity. Seller is not responsible if the item is damaged.
Each product will be photographed with an appropriate lighting configuration specific to the product’s characteristics.
The Seller will then check the quality of each photo and proceed to the selection and retouching stage.
ARTICLE 8 – FINALIZATION
The seller will send the customer sample photos to ensure that they meet the customer’s expectations and ask for approval.
If the customer has explicitly provided details about the desired photo, the seller will offer the customer a free retake, but these details will not be reflected in the final photo.
If the customer wishes to change the angle, style or other details of a photo that was not checked at the beginning of the shoot, an invoice for the new photo will be issued.
Invoices will be sent to the client after the photos have been verified and shot. Customers have 30 days to pay their fee.
After payment is received, the Seller sends the customer a link to download the photos.
The Seller sends the products back to the Customer. The Customer provides the Seller with a prepaid return label. Alternatively, the return shipping costs will be included in the final invoice.
ARTICLE 9 – RETENTION OF TITLE
The photographs taken during the photographic services with the customers are protected by the copyright. Even after the transfer of digital files, the photos remain the intellectual property of the photo agency and are not without rights. Only the client’s right to the image is inalienable. When a client purchases high definition digital files, he has the right to print, copy and save them on any medium he wishes. The client agrees to respect the integrity of the work of the photographic agency.
ARTICLE 10 – FORCE MAJEURE
Due to force majeure, irresistible or unforeseeable events, the parties are unable to perform their obligations, and neither party will assume any liability.
In particular, in the event of total or partial destruction of the business by fire, climatic events, natural disasters or any other accident, general strike, lack of motive power or shortage of raw materials for general reasons.
In case of force majeure, the delivery will be postponed to a later date after the end of the force majeure event and the customer and the seller will not be entitled to claim any compensation for possible damages.
In the event of force majeure exceeding four (4) weeks, the parties may elect to terminate the contract without charge by registered letter with acknowledgment of receipt
In this case, the Seller shall refund the amount paid by the Customer at the time of placing the order, to the exclusion of any other compensation that the Seller shall provide to the Customer.
ARTICLE 11 – CONTACT AND CUSTOMER SERVICE
To exercise his right of withdrawal, the client must send an email to Packshot Studio at the following address: contact@packshot.ma.
ARTICLE 12 – INFORMATION AND PERSONAL DATA
In accordance with the French Data Protection Act n°78-17 of January 6, 1978, customers have the right to access, rectify and oppose all their personal data at any time by sending a letter to the following address

Clients can receive quotes from Packshot Studio, its service providers and their partners according to the choices made by clients when creating or consulting their client account.
Clients can request to modify their selection at any time by sending an e-mail to contact@packshot.ma.
ARTICLE 13 – INTELLECTUAL PROPERTY
All texts, comments, images and photographs of products reproduced on the https://packshot.ma website are the exclusive property of Packshot Studio and are protected by copyright.
Any reproduction, even automated, of product presentation pages or any other pages of the site for commercial purposes is prohibited.
Only the automatic indexation of the pages of the site resulting from the natural referencing in the Internet search engines is authorized.
Any other use constitutes an act of infringement.
Packshot Studio reserves the right to take legal action to protect its rights against any person acting in violation of these provisions.
ARTICLE 14 – APPLICABLE LAW AND JURISDICTION
The present general conditions of sale are governed by French law.
Any dispute between the Vendor and the Customer resulting from the formation, interpretation or execution of the sales contract will be referred, in the absence of an amicable solution, to the territorially competent Courts.
